Devonport Pole Fitness Terms & Conditions

Payments and Refunds

​

Low number classes (1-2 students) may be cancelled and a make-up class pass provided for a class scheduled at the same time slot at the end of term.
 

In the event a class is cancelled due to a trainer unable to teach a class (illness, unforseen circumstance etc.), a class pass will be provided to be used within the same term in another class if suitable or another class provided at the end of the term if there are sufficient student numbers (see low number classes above).

Payment must be received in full prior to attending class. Refunds will not be provided if you cannot make your scheduled class. It is your responsibility to make it to your classes.

For all private classes we have a strict 24 hour cancellation policy. If you do not cancel via email or change your appointment within 24 hours, or if you do not attend your session, you will be charged the full fee.

 

Shutdown of studio (COVID-19 and other  unforseen circumstances)

In the event of future COVID-19 or other unforseen circumstances requiring shutdowns outside of the control of Devonport Pole fitness, current terms will be paused and recommence upon re-opening.

 

Students are required to follow all current government mandates, and/or studio requirements regarding health and safety of themselves and others when necessary..

 

Students are asked not to attend class if experiencing cold or flu like symptom.

 

Hand sanitiser is provided for use before and after class.

Safety

A Pre Exercise and Health Screening questionnaire must be completed by all new students prior to participating in a class. 


Students are to arrive 5 minutes before class so they do not miss the essential warm-up.

 

Students are to complete the “Late Warm Up” Independently if they arrive late to class.

 

Students cannot participate if under the influence of alcohol or illicit drugs.

Students are required to inform the instructor of any injuries that may impact their ability to participate safely in the class. 

 

In the event of an injury, students may be required to receive written advice from a GP, physiotherapist or registered health professional that has overseen the injury before returning to class. You will not be refunded for your courses, however you may access unused classes in a following term once medical clearance has been obtained. 

 

​Students are to use mats if working 1m above ground.

 

​Students are not to teach each other students tricks. You will be liable for their injuries

 

​

General Responsibilities

Students are required to bring their own water and microfibre cloth.

​

Students are to clean their own pole at the start and end of class. 


Devonport Pole Fitness is a safe and inclusive space for all people. Discrimination or bullying of any kind will not be tolerated.

 

Be kind and courteous to your classmates and instructors and we will do the same for you.


 

We encourage a body positive environment. Although we acknowledge that many people struggle with body image issues, we ask that students refrain from negative self talk during classes, and focus on supporting and encouraging each other in our pole journeys.

 

​Acknowledgement

By participating in classes you acknowledge that you have read, understood and agreed to the above terms and conditions.

WAIVER

I understand, acknowledge and agree that the activities of pole dancing are dangerous and as such, have inherent dangers and risks, including risk of injury or death. I acknowledge that the activities I undertake are at my own risk and therefore it would be unreasonable for Devonport Pole Fitness to be responsible in any way for any injury or any kind of death. I hereby waive all legal rights of action against and fully release Devonport Pole Fitness, it’s directors, instructors, employees, landlords and leases for the loss, damages or injuries arising out of or in relation to the participation by myself in the activities conducted or organised by Devonport Pole Fitness. By participating in classes you acknowledge that you have read, understood and agreed to the above terms and conditions.

Privacy Policy

Devonport Pole Fitness is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information. We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, and phone numbers. This Personal Information is obtained in many ways including intake forms, correspondence, by telephone, by email, and via our website www.devonportpolefitness.com. We don’t guarantee website links or policy of authorised third parties. We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing. When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:

• For the primary purpose for which it was obtained

• For a secondary purpose that is directly related to the primary purpose

• With your consent; or where required or authorised by law.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances including the following:

• Third parties where you consent to the use or disclosure; and

• Where required or authorised by law.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing. Devonport Pole Fitness will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information. In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is important to us that your Personal Information is up to date. We  will  take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
